A consumer in New York has launched a class action complaint against Vivid Seats, alleging that the ticket resale marketplace violated state law by not offering “all-in” ticket pricing. It centers on the plaintiff’s August 2023 purchase of tickets to a New York Mets game at Citi Field, where the complaint claims that the final ticket price differed dramatically from the amount that was initially displayed, breaking state law

A portion of the lawsuit states, “This is a class action based on Vivid Seats’… failure to properly disclose the total cost for purchase of tickets to New York based places of entertainment.”

It goes on to list the statutes it claims Vivid Seats allegedly breaks every day and states, “Defendant has violated [the law] by failing to disclose additional “fees” which increases the total cost of the ticket during the purchase process but is only disclosed after the ticket is selected for purchase.” “The fee is included in the total cost of the ticket price, irrespective of the ticket’s delivery method.”

Screenshots from Opening Day at Citi Field are included in the lawsuit’s formal complaint. The listings initially appear to be $80, but when substantial fees are added on a later screen, the price jumps.
